Drunk Driving

Most people who are arrested for operating while intoxicated (OWI) do not think of themselves as criminals. In fact, you may have never been in trouble with the law in your life. But because of the potential penalties and collateral consequences, you need to talk to an experienced criminal defense lawyer.

I'm Marc Hart. My law firm is devoted exclusively to defending people who have been accused of or charged with committing a crime. As a former prosecuting attorney, I now bring over 36 years of criminal courtroom experience  to the defense of every one of my clients in courts throughout Michigan.

Rather than just going for the quick and easy plea, I vigorously fight the allegations, go for the win at trial, or find the leverage necessary to minimize the penalties and consequences in every client’s case.

Take Your Drunk Driving Charge Seriously

If you were pulled over on suspicion of drunk driving in the Detroit area and asked to blow into a portable Breathalyzer, it is not the end of the story. A good lawyer can make a difference in the outcome, no matter what the charges or circumstances. Marc Hart handles all facets of drunk driving defense, including:
First offense of OWI or OWVI
Repeat offense or repeat OWI
Super drunk (blood alcohol of .17 or greater)
Zero tolerance (under 21 drinking and driving)
Commercial driver's license (CDL)
Breath test refusal
Child endangerment (OWI with a child in the car)
Drunk driving accidents (resulting in injury or death)

What are the Legal Penalties for Drunk Driving Crimes?

You may be charged with operating while intoxicated (OWI) if you fail the breath test (.08 or higher), or you may be charged with a lesser offense of operating while visibly impaired (OWVI) regardless of blood alcohol content.

The punishments are similar, and an OWVI essentially counts the same as OWI for purposes of subsequent offenses. One key difference is a flat suspension of your driver's license for OWI, while you can obtain a restricted license ("work permit") if convicted of an OWVI.

Whatever the charges, Mr. Hart will explain the potential punishments under Michigan law and explore all possible defenses for avoiding a criminal record or the harshest penalties.

"Words cannot express my gratitude for your kindness and generosity to me through this. I believe in angels, especially my guardian angel, who tends to work overtime! I never knew what to call him – I’ve always wanted to name my angel. I think I’ll call him “Marc”."

~ R.S.
