What are the Legal Penalties for Drunk Driving Crimes? You may be charged with operating while intoxicated (OWI) if you fail the breath test (.08 or higher), or you may be charged with a lesser offense of operating while visibly impaired (OWVI) regardless of blood alcohol content. The punishments are similar, and an OWVI essentially counts the same as OWI for purposes of subsequent offenses. One key difference is a flat suspension of your driver's license for OWI, while you can obtain a restricted license ("work permit") if convicted of an OWVI. Whatever the charges, Mr. Hart will explain the potential punishments under Michigan law and explore all possible defenses for avoiding a criminal record or the harshest penalties. |
